We have a Constitution in this Country. USE IT. If you are caught because you have accidentally put the wrong article in the wrong bin, you are indeed innocent until proven guilty. This is part of YOUR Constitution.
If no one makes a stand NOW, you may all end up with being "micro-chipped" at birth, monitored and logged where ever you go and what ever you do. In case you have forgotten-which the government would perhaps like you to do-you have a Constitution (the foundation upon which all laws in this Country should be made) that says you are 'innocent until proven guilty', and fined according to the laws of this land, which are clearly stated in Magna Carta, and the Bill of Rights 1688/9.
Our Bill of Rights 1688/9 makes clear, "That excessive bail ought not to be required; nor excessive fines imposed; nor cruel and unusual punishments inflicted. These are from our Constitution, the law above the law, the foundations upon which all other laws are or should, be built. If you think a fine is "just" for accidentally putting the wrong rubbish in the wrong bin, then go ahead, pay the fine, OK, accept it, and then something else may be found for you to pay a fine on. And so it will go on.
Clause 29 Magna Carta makes clear that "for a trivial offence, a free man shall be fined only in proportion to the degree of his offence, and for a serious offence correspondingly, but not so heavily as to deprive him of his livelihood. In the same way, a merchant shall be spared his merchandise, and a husbandman the implements of his husbandry, if they fall upon the mercy of a Royal Court. None of these fines shall be imposed except by the assessment on oath of reputable men of the neighbourhood".
Magna Carta 39. NO FREEMAN SHALL BE TAKEN OR IMPRISONED, OR DISSEISED, OR OUTLAWED, OR BANISHED, OR ANY WAYS DESTROYED, NOR WILL BE P**** UPON HIM, NOR WILL WE SEND UPON HIM, UNLESS BY THE LAWFUL JUDGMENT OF HIS PEERS, OR BY THE LAW OF THE LAND. (The law of the land has to be according to our Constitution)
40. WE WILL SELL TO NO MAN, WE WILL NOT DENY TO ANY MAN, EITHER JUSTICE OR RIGHT.
No court in this land may alter an EU Directive or Regulation so why is this Government ignoring our and their own Constitution.
If it is correct that this proposed £70 fine is "– MORE THAN MANY SHOP-LIFTERS (THIEVES), DRUG AND DANGEROUS DRIVERS". Then I would suggest it is indeed an excessive fine.
It is of course much simpler just to pay the fine and have done with it. That is why the 'Instant fine' has been brought forward and in just accepting it, not only are you parting with your hard earned money "for a mistake", you too are ignoring the Constitution that is there for you to use.
Sadly, these days it can cost a great deal more money and time to go to court to prove your innocence, than pay an instant fine, but unless you make a stand-ALL OF YOU- quit moaning.
